O objetivo deste estudo de caso era saber de que forma os requisitos da política de patentes dos EUA diferem para as indústrias de software e farmacêutica, especificamente se a política de patentes dos Estados Unidos protege adequadamente os direitos de propriedade intelectual (DPI) para duas indústrias divergentes, ao mesmo tempo que incentiva o investimento em investigação e desenvolvimento (I&D) suficiente para aumentar os lucros e a inovação. Os dados para este estudo consistiram em 38 testemunhos prestados ao Congresso dos EUA entre 2005 e 2010 por peritos que representam as duas indústrias de interesse: farmacêutica e de software.
