Le présent travail de recherche est axé sur l’analyse juridique des articles pertinents du Statut de la Cour pénale internationale concernant l’obligation de coopération entre les États pour la répression des crimes graves contre l’humanité et la guerre. Le développement judiciaire, en commençant par les Tribunaux ad hoc et en arrivant à des causes à différents stades des procédures toujours en cours à la Cour Pénale Internationale, ouvre les débats doctrinaux et comparatifs nationaux surtout dans le cas de manque de coopération des Etats ; en cherchant à élaborer sur des sujets spécifiques tels que l’obligation de coopération des États, les demandes d’assistance pendant les enquêtes préliminaires, les demandes d’assistance pendant les enquêtes, les informations confidentielles, l’assistance de la Cour aux États parties au Statut, la suspension de l’exécution d’une demande, le rôle du Procureur et la non-assistance de certains États qui, pour des raisons politiques et non seulement, entravent le développement et le fonctionnement de la justice pénale internationale.
